This Digital Millennium Copyright Act (“DMCA”) Policy outlines our procedures for addressing claims of copyright infringement on our website.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please follow the procedures outlined below.

Reporting Copyright Infringement

If you believe that any content on SnapCaptions infringes your copyright, you may submit a notification pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by this notification, you may provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the URL of the page in question to help us identify the content.
  3. Contact information for the complaining party, including a name, address, telephone number, and email address.
  4. A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Copyright Agent:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your area, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original claim of infringement.

If the original claimant does not file a court action within 10 business days of receiving the counter-notification, we may restore the removed material.

Repeat Infringers

In accordance with the DMCA and other applicable laws, SnapCaptions has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

We may also, at our discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Changes to This Policy

We reserve the right to update or modify this DMCA Policy at any time without prior notice. Any changes will be effective immediately upon posting to this page.
